Urologist shot dead in exam room; man in custody

NEWPORT BEACH, Calif. (AP) ? A 75-year-old retired barber was jailed Tuesday for investigation of killing a urologist in his exam room, but police have not yet released a motive.

Stanwood Fred Elkus of Lake Elsinore was arrested following the Monday afternoon attack and held on $1 million bail, according to the county jail website.

Elkus is suspected of killing Dr. Ronald Franklin Gilbert, 52, of Huntington Beach at the medical office in Orange County.

Police said they found Elkus and Gilbert in a second-floor room after several 911 callers reported six or seven shots fired. A gun was found at the scene.

The doctor had been shot several times in the upper body and was declared dead at the scene in Newport Beach.

Elkus had surgery for a prostate problem but he never specifically said Gilbert was his doctor, said his neighbor James Lord.

"He never complained to me about the doctor," Lord said.

On Sunday, Elkus asked Lord to fix the brake pedal on his car and "he kind of mentioned that he wasn't going to be around much longer," Lord said.

"I told him 'no Stan, you're gonna outlive me,'" Lord said.

Elkus, who lived alone, was familiar with guns, Lord said.

"We talked about guns before," he said. "He'd go out shooting, target practice. He'd go to target ranges.

"I just can't believe that he did it," Lord said. "He was a nice guy. ... He didn't seem like he was going to flip out or anything."

An autopsy was planned Tuesday and Elkus was scheduled to appear Wednesday in court. Police searched his home but declined to disclose what they found.

Gilbert, a married father of two children, appeared to be the only target of the attack, police spokeswoman Kathy Lowe said.

Dr. Jeffrey Lauber, a dermatologist, said he frequently referred patients with cancer symptoms to Gilbert.

"He's the best there is," Lauber said. "Not only is he a very good urologist, he's a pillar of the community."

Lauber couldn't imagine why anyone would want to shoot Gilbert.

"This doesn't happen down here," he said of the wealthy enclave 45 miles southeast of Los Angeles.

Gilbert dealt with general urology, sexual dysfunction and related surgical techniques including vasectomies, bladder and prostate cancer, according to his biography on the website of the Orange Coast Urology Group, which he joined in 1993.

One of his specialties involved using a laser to vaporize prostate tissue blocking the urinary tract. His biography called him a "people person" and said he enjoys helping people.

He decided to become a doctor mainly because his late father was a doctor, the biography said, adding that Gilbert had been a stockbroker and a singer in a rock band.

Endangered baby pygmy elephant found clinging to dead mother

KUALA LUMPUR, Malaysia (AP) ? Ten endangered Borneo pygmy elephants have been found dead in a Malaysian forest under mysterious circumstances, and wildlife officials said Tuesday that they probably were poisoned.

Carcasses of the baby-faced elephants were found near each other over the past three weeks at the Gunung Rara Forest Reserve, said Laurentius Ambu, director of the wildlife department in Malaysia's Sabah state on Borneo island.

In one case, officers rescued a 3-month-old calf that was trying to wake its dead mother.

Poisoning appeared to be the likely cause, but officials have not determined whether it was intentional, said Sabah environmental minister Masidi Manjun. Though some elephants have been killed for their tusks on Sabah in past years, there was no sign that these animals had been poached.

"This is a very sad day for conservation and Sabah. The death of these majestic and severely endangered Bornean elephants is a great loss to the state," Masidi said in a statement. "If indeed these poor elephants were maliciously poisoned, I would personally make sure that the culprits would be brought to justice and pay for their crime."

The WWF wildlife group estimates that fewer than 1,500 Borneo pygmy elephants exist. They live mainly in Sabah and grow to about eight feet tall, a foot or two shorter than mainland Asian elephants. Known for their babyish faces, large ears and long tails, pygmy elephants were found to be a distinct subspecies only in 2003, after DNA testing.

Their numbers have stabilized in recent years amid conservation efforts to protect their jungle habitats from being torn down for plantations and development projects.

The elephants found dead this month were believed to be from the same family group and ranged in age from 4 to 20 years, said Sen Nathan, the wildlife department's senior veterinarian. Seven were female and three were male, he said.

Post-mortems showed they suffered severe hemorrhages and ulcers in their gastrointestinal tracts. None had gunshot injuries.

"We highly suspect that it might be some form of acute poisoning from something that they had eaten, but we are still waiting for the laboratory results," Nathan said.

We agree wholeheartedly with the opinions expressed by Peter King in his latest Monday Morning Quarterback and elsewhere regarding the merit (or more accurately lack thereof) of former Raiders receiver Tim Brown?s non-allegation allegation that former Raiders coach Bill Callahan ?sabotaged? a 10-year-old Super Bowl.? But some questions remain as the latest Super Bowl week commences.

First, will 49ers coach Jim Harbaugh be asked about the situation at one of his many media availabilities this week?? Harbaugh, who was a first-year offensive assistant with the Raiders in 2002, wasn?t asked about it on Sunday night when the team arrived.? And given the extent to which the story has faded in recent days, he may not be asked about it at all.

Second, did the Raiders? game plan change two days before the game?? Brown?s ludicrous opinion of sabotage comes from his belief, as a factual matter, that Callahan changed the game plan.? So did he?? There has been no definitive answer provided to that question.

Third, did the Raiders fail to change audibles and line calls?? It has been presumed for nearly a decade that the Raiders didn?t account for the fact that former Oakland coach Jon Gruden knew the code words that would be used at the line of scrimmage on offense.? But Peter King?s dismantling of the sabotage theory in the latest Monday Morning Quarterback extends to the notion that the Bucs knew what the Raiders were planning to do.? The game broadcast, however, contained strong evidence to the contrary.

Tampa Bay safety John Lynch wore a microphone, and he plainly can be heard telling former Bucs defensive backs coach Mike Tomlin after the Raiders fell behind 20-3 late in the first half, ?Mike, every play they?ve run, we ran in practice.? It?s unreal.?

Said Tomlin, ?I know.?

Whatever the reason, the Buccaneers? dominance was enough, we?re told, to prompt Raiders receiver Jerry Rice to rip the microphone he was wearing during the game from his pads and flush it down a toilet at halftime.

Fourth, given that King believes Brown?s assertion is ?utterly preposterous? and that King is one of the voters for induction into the Pro Football Hall of Fame, will this mess keep Brown out for another year?? The voters will swear that they don?t consider anything other than what happens on the field, in accordance with the Hall of Fame?s bylaws.? But as we explained in our one-time-and-one-time-only PFT season preview magazine (which apparently made a cameo appearance several months ago in an episode of Mike & Molly on CBS), the human beings who cast the votes are influenced by the things that tend to influence the decisions made by human beings.

If it?s a close call between Brown and someone else as a given voter makes the excruciating descent from 15 modern-era finalists to up to five modern-era enshrinees, Brown?s assertions could be viewed, consciously or otherwise, as reflecting the kind of disrespect for and misunderstanding of the game that could be the factor pushing that person one way or the other.

There would be no hard proof of it, and none of the voters will risk their vote by proclaiming publicly that they sabotaged Brown?s candidacy in part because of his claim of sabotage.? But it definitely could, in a close case, be a factor ? and we?d never know that it was.

U.S. condemns sentencing of American pastor in Iran

WASHINGTON (Reuters) - The U.S. State Department on Sunday condemned an Iranian court for sentencing an Iranian-American Christian pastor to eight years in prison.

The State Department said it had confirmed reports of Saeed Abedini's sentencing with the family's attorney and called for his release.

"We condemn Iran's continued violation of the universal right of freedom of religion and we call on the Iranian authorities to respect Mr. Abedini's human rights and release him," State Department spokesperson Darby Holladay said.

Hollaway said Abedini's attorney had only one day to present his defense and the department was deeply concerned about the fairness and transparency of his trial.

The American Center for Law and Justice, a conservative lobbying group, said Abedini was convicted by Judge Pir-Abassi of Branch 26 of the Iranian Revolutionary Court for threatening Iran's national security through his leadership in Christian house churches.

It said Abedini, a 32-year-old father of two, became a U.S. citizen in 2010 through marriage to his American wife Naghmeh.

He was ordained a minister in 2008 through the American Evangelistic Association and had been traveling back and forth freely between the U.S. and Iran for three years until this past summer, when he was placed on house arrest. He was imprisoned in September.

The ACLJ, which is representing Abedini's U.S.-based wife and children, said the pastor had been beaten and tortured during his time in prison, raising questions about his medical condition.

It said Abedini and his attorney were only allowed to attend one day of his trial, which started on January 21.

"This is a real travesty - a mockery of justice," said ACLJ's Executive Director Jordan Sekulow. "From the very beginning, Iranian authorities have lied about all aspects of this case, even releasing rumors of his expected release. Iran has not only abused its own laws, it has trampled on the fundamentals of human rights."

In a statement, Naghmeh Abedini said she is "devastated" for her husband and her family - a six-year-old daughter and a four-year-old son.

"We must now pursue every effort, turn every rock, and not stop until Saeed is safely on American soil," she added.

Egyptian protesters violently defy curfew, rules

CAIRO/ISMAILIA, Egypt (Reuters) - Egyptian protesters defied a nighttime curfew in restive towns along the Suez Canal, attacking police stations and ignoring emergency rule imposed by Islamist President Mohamed Mursi to end days of clashes that have killed at least 52 people.

At least two men died in overnight fighting in the canal city of Port Said in the latest outbreak of violence unleashed last week on the eve of the anniversary of the 2011 revolt that brought down autocrat Hosni Mubarak.

Political opponents spurned a call by Mursi for talks on Monday to try to end the violence.

Instead, huge crowds of protesters took to the streets in Cairo, Alexandria and in the three Suez Canal cities - Port Said, Ismailia and Suez - where Mursi imposed emergency rule and a curfew on Sunday.

"Down, down with Mohamed Mursi! Down, down with the state of emergency!" crowds shouted in Ismailia. In Cairo, flames lit up the night sky as protesters set police vehicles ablaze.

In Port Said, men attacked police stations after dark. A security source said some police and troops were injured. A medical source said two men were killed and 12 injured in the clashes, including 10 with gunshot wounds.

"The people want to bring down the regime," crowds chanted in Alexandria. "Leave means go, and don't say no!"

The demonstrators accuse Mubarak's successor Mursi of betraying the two-year-old revolution. Mursi and his supporters accuse the protesters of seeking to overthrow Egypt's first ever democratically elected leader through undemocratic means.

Since Mubarak was toppled, Islamists have won two referendums, two parliamentary elections and a presidential vote. But that legitimacy has been challenged by an opposition that accuses Mursi of imposing a new form of authoritarianism, and punctuated by repeated waves of unrest that have prevented a return to stability in the most populous Arab state.

WEST UNNERVED

The army has already been deployed in Port Said and Suez and the government agreed a measure to let soldiers arrest civilians as part of the state of emergency.

The instability unnerves Western capitals, where officials worry about the direction of powerful regional player that has a peace deal with Israel. The United States condemned the bloodshed and called on Egyptian leaders to make clear violence is not acceptable. ID:nW1E8MD01C].

In Cairo on Monday, police fired volleys of teargas at stone-throwing protesters near Tahrir Square, cauldron of the anti-Mubarak uprising. Demonstrators stormed into the downtown Semiramis Intercontinental hotel and burned two police vehicles.

A 46-year-old bystander was killed by a gunshot early on Monday, a security source said. It was not clear who fired.

"We want to bring down the regime and end the state that is run by the Muslim Brotherhood," said Ibrahim Eissa, a 26-year-old cook, protecting his face from teargas wafting towards him.

The political unrest in the Suez Canal cities has been exacerbated by street violence linked to death penalties imposed on soccer supporters convicted of involvement in stadium rioting in Port Said a year ago.

Mursi's invitation to opponents to hold a national dialogue with Islamists on Monday was spurned by the main opposition National Salvation Front coalition, which rejected the offer as "cosmetic and not substantive".

The only liberal politician who attended, Ayman Nour, told Egypt's al-Hayat channel after the meeting ended late on Monday that attendees agreed to meet again in a week.

He said Mursi had promised to look at changes to the constitution requested by the opposition but did not consider the opposition's request for a government of national unity.

The president announced the emergency measures on television on Sunday: "The protection of the nation is the responsibility of everyone. We will confront any threat to its security with force and firmness within the remit of the law," Mursi said.

His demeanor in the address infuriated his opponents, not least when he wagged a finger at the camera.

Some activists said Mursi's measures to try to impose control on the turbulent streets could backfire.

"Martial law, state of emergency and army arrests of civilians are not a solution to the crisis," said Ahmed Maher of the April 6 movement that helped galvanize the 2011 uprising. "All this will do is further provoke the youth. The solution has to be a political one that addresses the roots of the problem."

Economists feeling more optimistic about 2013

Economists are increasingly optimistic about growth in the year ahead with hiring expected to pick up in coming months.?

A quarterly survey by the National Association for Business Economists released Monday shows half of the economists polled now expect real gross domestic product ? the value of all goods and services produced in the United States ? to grow between 2 and 4 percent in 2013. That's up from 36 percent of respondents who felt the same way three months earlier.?

About half expect sluggish or negative performance, down from 65 percent in October.?

The latest survey was conducted between Dec. 20 and Jan. 8 and asked 65 economists and others who use economics in the workplace about conditions at their firms or industries. It found that 34 percent of firms now expect to expand their payrolls in the next six months, the highest percentage since April of last year. Meanwhile, 2 percent said they expect their companies to cut payrolls through layoffs, while 14 percent see payrolls trimmed through attrition.?

A quarter of respondents also said employment grew at their firms in the fourth quarter, which is comparable to the levels seen in the first half of 2012. The same percentage also reported a rise in wages at their firms in the final three months of the year, up 10 percentage points from the last survey.?

Overall sales growth was stable in the fourth quarter with results mixed across industries. For instance, growth slowed in the services, finance, insurance and real estate sectors, but rose in the transportation, utilities, information and communications sectors.?

Timothy Gill, chair of NABE's survey committee and director of economics at the National Electrical Manufacturers Association, noted that sales growth was stable despite "widespread uncertainty surrounding the potential impact of the fiscal cliff."?

The "fiscal cliff" refers to the steep tax hikes and spending cuts that were to take effect Jan. 1 unless the White House and Congress reached an agreement to avoid them. The survey found that 27 percent of respondents postponed at least some hiring and capital spending during the quarter as a result, while 72 percent said the issue didn't affect hiring.?

Despite stable sales growth, survey respondents noted that profit margins deteriorated in the fourth quarter, with 25 percent saying their margins increased, down from 27 percent in October. On the flipside, 18 percent reported declining profit margins, compared with 15 percent a year ago. Over the next three months slightly more than a third said they expect primary non-labor costs to rise. That's down from 43 percent in the previous survey.?

Expectations for capital spending over the next year weakened from the last survey. Only 40 percent expect their firms to grow capital spending, down from 52 percent.?

For consumers, the survey suggests modest inflation could be in the works, with two-fifths of respondents ? the highest share over the past year ? saying they expect prices to rise in coming months. Most of those expecting hike prices think the increases will be less than 5 percent.?
